Illinois has a Medigap birthday rule, but it is narrower than most people are told, and getting it wrong is expensive.

If you already hold a Medicare Supplement policy, you get 45 days beginning on your birthday to move to another policy without medical underwriting. Three conditions apply, and all three must be met.

  • You must be between 65 and 75. At 76 the window closes for good.
  • The new policy must be with the same insurer or an affiliate — this is not a license to shop the whole market.
  • The new policy must carry equal or lesser benefits than the one you hold.

The rule was revised on January 1, 2026 under Public Act 103-0747. If anyone has told you that Illinois lets you change Medigap carriers freely each year, or that the window runs past 75, they were describing a different state.

Outside that window, and outside a guaranteed-issue situation, an Illinois carrier may ask health questions, charge more, or decline you. Your one unconditional opportunity is the six-month Medigap Open Enrollment Period that starts when your Part B begins.

The catch: you may only move within the same company or its affiliates. If your insurer has raised rates and you want a different one, the rule does not get you there. Outside the window, and outside a federal guaranteed-issue situation, an application is medically underwritten and can be declined.

Two federal trial rights are the exception and both are one-time. If you joined a Medicare Advantage plan when first eligible at 65, or dropped a supplement to try Advantage for the first time, you can return without health questions provided you act within twelve months and apply no more than 63 days after that coverage ends.
